New York nursing home malpractice laws

There are both New York State and USA federal laws that regulate how nursing homes operate to ensure the safety and well-being of all residents. These laws include things like how big the facility should be, number of beds provided, licenses they need to hold, what regulations staff need to follow, and more.

In New York, we have something called the Patient Abuse Reporting Law.

This law requires that:

“Staff of nursing homes and hospitals are required to report suspected instances of "abuse, mistreatment, and neglect" in order to protect the health and safety of persons residing in nursing homes. If there is reasonable cause to suspect that abuse, mistreatment and neglect has occurred in the nursing home, it needs to be promptly reported to the Department. The failure of licensed health care personnel to report instances of physical abuse, mistreatment and neglect for patients who are residents of nursing homes is professional misconduct subject to a civil penalty.”
